Terms & Conditions
- General
- The owner of this web site is Alison Victoria Limited, 71 Market Street. Ashby-de-la-Zouch, Leicestershire, LE65 1AH.
- You agree that e-mail can be used as a long-distance means of communication.
- No contract for the sale of any product will subsist between you and Fabulous Fabric unless and until Fabulous Fabric accepts your order by way of a phone call or an e-mail confirming that it has received payment in full for all the goods you have ordered.
- Fabulous Fabric will not pass on your personal or credit or debit card details to any third party.
- You undertake that all details you provide to Fabulous Fabric for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
- If there are any changes to the details supplied by you it is your responsibility to inform Fabulous Fabric as soon as possible.
- Prices
- Prices are correct at the time of receipt but may be liable to change without notice during the life of the sample.
- Delivery
- Delivery is normally made by first class post or parcel post 3 day delivery depending on weight. Orders are despatched as quickly as possible.
Delivery dates are approximate only and while every effort will be made to provide a speedy efficient service, the company cannot accept responsibility for any delays, however incurred. All deliverys outside of the UK will be charged at cost.
- Claims
- Claims for shortages or damage must be made in writing to the company within 7 days of receipt of goods.
- In the event of non delivery, all claims will be made by us (not the customer) and any claim refunds will be passed on to the customer when settlement is made by the carrier.
- Returns
- Fabulous Fabric Collection does not operate a sale or return scheme.
- Returns for any reason must be arranged with the company within 7 days of receipt of order.
- We reserve the right to make a handling charge where goods have been supplied in accordance with your order.
- Any agreed returns must be in a resalable condition.
- Items supplied as special order are not returnable.
- Goods received damaged must be reported within 7 days. Goods that are soiled or damaged after receipt cannot be accepted for credit or replacement.
- Reservation of Title
- Goods supplied remain the property of Fabulous Fabric Collection until paid for in full. Consequential damages cannot be accepted under any circumstances.
- Colour and specifications shall be subject to reasonable commercial variation and tolerance.
- Liability
- This section applies only to the extent permitted by law. For the avoidance of doubt, Fabulous Fabric do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from Fabulous Fabric's negligence or wilful default, or that of Fabulous Fabric's employees, agents or subcontractors or (b) fraudulent misrepresentation.
- Fabulous Fabric does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services.
- If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on the Site is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price.
We shall give you the option of confirming the order at the correct price or if you so choose, to cancel the order altogether. If you cancel and have already paid for the goods in the circumstances described in this clause, we shall refund the full amount in accordance with these Terms.
- Fabulous Fabric will do its best to correct errors and omissions as quickly as practicable after being notified of them.
- TO THE FULLEST EXTENT PERMITTED BY LAW, FABULOUS FABRIC IS PROVIDING THIS SITE AND ITS CONTENTS ON AN "AS IS" BASIS AND MAKES NO (AND EXPRESSLY DISCLAIMS ALL) REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THIS SITE OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED IN THIS SITE INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN ADDITION, FABULOUS FABRIC DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THIS SITE IS ACCURATE, COMPLETE OR CURRENT.
- Proper Law
- These Terms are subject to the laws and exclusive jurisdiction of the United Kingdom.
